MailAutomation Inc. ("Company") offers a special Lifetime Deal ("Offer") for MailTracker at a one-time fee of $199 USD ("Fee"). This Offer is strictly non-refundable and non-transferable under any circumstances.
2. Offer Validity
- The Offer is valid 24 hours, inclusive ("Offer Period").
- The Offer is available only to new accounts and email addresses that are not existing customers of MailTracker ("Eligible Users"). Any current paid accounts that are canceled in an attempt to avail of this Offer will result in the immediate termination of the new subscription obtained under this Offer.
3. Payment and Subscription
- Payment of the Fee must be completed in full before the activation of the subscription ("Subscription").
- By subscribing to this Offer, the user ("Subscriber") explicitly agrees to all the terms and conditions outlined herein ("Terms").
4. Access and Features
- The Offer provides the Subscriber with perpetual access to MailTracker services ("Services").
- The Subscription includes unlimited email tracking.
- The Subscriber will have access to all features available in the Growth plan, which is ordinarily priced at $24 USD per month.
- The Offer guarantees access to future updates and features of MailTracker, as long as these updates fall within the scope of the Growth plan.
5. Conditions of Use
- The Subscriber agrees that the Offer is non-refundable and non-transferable. No exceptions will be made under any circumstances.
- The Subscription is personal to the Subscriber and may not be transferred or assigned to any other person or entity.
- The Company reserves the right to modify, suspend, or terminate the Offer or the Subscription at any time if the Subscriber violates any of these Terms or engages in any fraudulent or illegal activities.
6. Limitation of Liability
- To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from the Subscriber's use of the Services.
7. Indemnification
- The Subscriber agrees to indemnify, defend, and hold harmless the Company and its affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with the Subscriber's access to or use of the Services, or violation of these Terms.
8. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law principles.
9. Entire Agreement
- These Terms constitute the entire agreement between the Subscriber and the Company regarding the Offer and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Offer.
By subscribing to this Lifetime Deal, the Subscriber acknowledges and agrees to these Terms and Conditions without reservation. This agreement constitutes a binding contract between the Subscriber and MailAutomation Inc. for the use of MailTracker services under the specified terms.
